By submitting the online order form(s) or by using Creative Suites’ service, Customer hereby agrees to Creative Suites’ Terms of Service (TOS), No Spam Policy (NSP), and Privacy Policy.

Customer agrees that it shall comply with this TOS, and NSP. Customer further agrees that it has read Creative Suites’ Privacy Policy and agrees to all the terms and conditions in the Privacy Policy.

1. General Terms

In consideration of hosting, design, maintenance, and setup services to be delivered, Customer agrees to be bound by the following terms and conditions:

  • 1.1 Customer agrees to pay, in advance of each service term for hosting, design, maintenance, and setup services to be rendered.
  • 1.2 Customer agrees to a no-refund policy in advance. Design service fees are non-refundable.
  • Customer agrees not to engage in any activity that violates any international, foreign, federal, state, or local laws applicable to the service terms described in this agreement.

2. Agreement for Services

Creative Suites will provide, and Customer will purchase and pay for the web hosting, designs, maintenance, and setup services (the “Services”), according to the service fees specified in the Order for the applicable Service Description. Customer acknowledges that the service, and service fees have been communicated to the Customer, and that Customer is aware of all applicable charges as per the Agreement.

3. Payment

Establishment and provision of service is contingent upon receipt of payment from Customer to Creative Suites. All payment will be made in U.S. dollars.

4. Account Cancellation

Customers may voluntarily cancel their account at any time, for any reason or for no reason, by filling out the “Cancellation Request Form” which is provided on the Creative Suites Web site. You can find the “Cancellation Request Form” at the following Web page:

Once a Customer has cancelled their account, no more charges will be billed to the account. However, Customer understands and agrees that Creative Suites does not provide pro-rated or any other kinds of refunds on Cancellations. All fees Customer has paid shall be nonrefundable.

5. Refunds and Disputes

IMPORTANT NOTICE: EXCEPT AS EXPLICITLY PROVIDED IN THIS SECTION 5, ALL PAYMENTS TO CREATIVE SUITES ARE NONREFUNDABLE.

If Customer finds that within thirty (30) days of obtaining their web hosting account and they cancel, they will be refunded. However, if Customer’s account has been terminated within the first thirty days because of failure to follow TOS, then Customer’s money will not be refunded.

If Customer has paid for a setup or maintenance fee and decides to cancel before any setup or maintenance service has been offered, then Customer’s money shall be refunded.

6. No Free Service to Be Offered

Customer may not use THEIR web hosting account to offer any of the following kinds of FREE services but are not limited to:

  • Free Web hosting services
  • Free e-mail services
  • Free blogging services
  • Free home pages
  • Free image hosting
  • Free trial accounts

There are several reasons for these prohibitions on free services. The reasons include, but are not limited to, the following:

First, free services generally do not require any reliable means of identifying the person who registers for them. As such, it can be practically impossible to track down persons who abuse the free services.

Second, users of free services are notorious for registering for free accounts and immediately spamming or otherwise consuming very large amounts of system resources and bandwidth before their accounts are shut down. Such abusers often register for successive or multiple accounts and cause many problems for the servers and networks.

Third, spammers, operators of phishing and pharming scams, distributors of spyware, viruses, Trojan horses, worms, and other malware, operators of illegal Warez sites, operators of illegal or unauthorized file-swapping or archive sites, and hackers frequently abuse free online services. Allowing free services would expose OUR server to severe abuse and could harm US, all of OUR customers, and all the customers on OUR server.

Fourth, free services lead to various forms of abuses that may violate criminal laws or even foster terrorist activities. Because such abuses violate applicable laws as well as OUR policies, WE must prohibit them.

If YOU violate this prohibition on free services, WE may suspend or terminate YOUR account immediately, with or without notice, as WE in our sole discretion deem necessary to address the situation.

7. Adult Oriented Work

No services will be granted to any non-commercial or commercial adult oriented site. Furthermore, all hosting accounts agree that they will not publish any adult oriented material on their site. If you’re caught with adult oritented material on your hosting accoutn, you will be asked to take it off. Failure to do so will result in termination.

8. Designs

All designs were created for you, and only you. You may not redistribute graphics for free or monetary worth, nor may you claim any designs as yours.

9. Creative Suites No-Spam Policy (NSP)

  • 9.1 Customer shall comply with all the terms and conditions of Creative Suites’ No-Spam Policy (NSP) as descirbed in this Section 7. Violation of the NSP shall be deemed a violation of this AUP and of the Customer’s Agreement with Creative Suites.
  • 9.2 At Creative Suites, we are committed to providing valuable hosting, design, maintenance, and setup services to our valued customers.
  • 9.3 An important part of Creative Suites’ mission is to be a respected and responsible member of the business and Internet communites. We take seriously our role in protecting our customers and the general public from nuisances such as “spam”. This section describes our NO-SPAM Policy. Please read it carefully, because it contains important information and because it it a material of your Agreement with Creative Suites.
  • 9.4 To report any spam you receive that identifies itself as coming from the creative-suites.com server or claim to be related to Creative Suites in any way, please send an e-mail to us at cs@creative-suites.com. In your message to us, please include a complete and accurate copy of the message that you consider to be spam, along with full message headers and routing information for e-mail, a message board provided by a Web site or an online service, Usenet, interactive chat message, or instant message service, as the case may be.
  • 9.5 Definition of Spam.

Unsolicited commercial e-mail and electronic messages are colloquially referred to as “spam”. Other common names for spam include “spam e-mail,” “junk e-mail,” “bulk e-mail,” “direct e-mail,” and “mass e-mail.” Spam is the electronic equivalent of the direct mail you receive in you postal mailbox frequently. In its most general terms, and as used in this NO-SPAM Policy (the “Policy”), spam is:

  • a commercial e-mail message or other electronic message, including, but not limited to, messages that are:
    • posted to an electronic mailing list (other than an “opt-in” e-mail list as described below),
    • posted on an online bulletin board system or Web-based message board system or “guest book”,
    • posted to a Usenet newsgroup,
    • posted to the common area of an online community, group, or club,
    • posted in a chat room,
    • posted in a message board or a commercial online service (such as America Online),
    • posted to a Weblog (”blog”),
    • sent via an instant message system (such as ICQ, Yahoo! Pager, Yahoo! Instant Messenger, or AOL Instant Messenger),
    • sent through e-mail or another Internet means of communication when the message’s ultimate destination is a facsimile (”fax”) machine, cellular or wireless telephone, or wireless device,
  • a commercial e-mail message or other electronic message that is addressed to one or more recipients with whom you do not have an preexisting business or personal relationship,
  • a commercial e-mail message or other electronic message that is sent to a mailing list of addresses that you purchased or that were otherwise distributed, or any list of e-mail addresses whose owners did not sign up for your specific mailing list, including without limitation lists commonly known as “affiliate lists,”
  • a commercial e-mail message or other electronic message that is not sent at the request of, or with the express consent of, the recipient(s),
  • a commercial e-mail message or other electronic message that is sent to a recipient who has opted out of receiving furthur commercial electronic messages from you, or
  • a commercial e-mail message or other electronic message that contains forged headers, compromised mail server relays, or false contact information.

For purposes of this Policy, spam also includes any e-mail or other electronic message that is sent in violation of any applicable Federal, state, or local law regulating unsolicited commercial e-mail, unsolicited fax transmissions, or any other type of unsolicited commercial electronic message, regardless of whether that message fits the definition of “spam” provided above.

10. Privacy Policy

Creative Suites typically receives specific data about its Web site visitors only when such information is provided voluntarily, such as when our visitors request information, purchase or enroll for services, or send us e-mail. Of course, some of these activities require that you give us information, such as when you make a purchase or request certain types of information. We collect the following types of information about you.

  • Contact Information
    • Name
    • Company
    • Postal Address
    • City
    • State
    • Country
    • Zip code or postal code
    • Email address
    • Internet domain name
  • Verification Data
    • Internet Protocol (IP) address for fraud-prevention purposes
  • Other Information
    • Account password - only as a last resort to solve any account problems

When you provide personally identifiable information to Creative Suites through one of our Web sites, it will be used to fulfill your specific request. However, Creative Suites reserves the right, in its discretion, to send you bulletins and other important information about your Creative Suites services.

Creative Suites occasionally sends service communication e-mails. The service communication e-mails are essential to our registering you for service and to our continuing provision of services to you. Therefore, you may not opt out of receiving these e-mail messages.

Creative Suites will not, however, sell, trade, or otherwise disclose your personally identifiable information unless we are authorized or legally required to do so, or in the case of imminent physical harm to any person.

10.2 Sale or Transfer of Information

Creative Suites will not sell or transfer any of your personally identifiable information to any third party site or company.

10.3 Access to Personally Identifialbe Information

If your personally identifiable information changes, you may update it by making the change on our member information page at the following web page:
